Scope of this Limited Commercial Warranty
Ma Maison Floors ("Ma Maison," "we," "us," or "our") offers this comprehensive 10-year limited warranty to the original commercial purchaser (the "Purchaser") of Ma Maison wood flooring products (the "Flooring") installed in a light commercial property within the United States or Canada.
This warranty provides coverage against certain manufacturing defects in the Flooring and defects in the factory-applied finish, under normal light commercial use for a period of ten (10) years from the date of original purchase. This warranty is non-transferable and applies only to Flooring purchased through an authorized Ma Maison Floors dealer.
The specific defects covered by this warranty include issues related to the core construction of the Flooring, such as the delamination of layers, improper assembly, inaccuracies in milling and dimension, and deviations from the specified grading of the wood. The factory-applied finish is warranted against wearing through or separating from the underlying wood surface under normal light commercial foot traffic and use.
Conditions and Exclusions of this Limited Commercial Warranty
To ensure the validity and continued coverage of this limited warranty, several important conditions must be strictly adhered to:
Proper Installation and Maintenance: The Flooring must be installed indoors, in a dry, climate-controlled environment, and continuously maintained within a relative humidity range of 30% to 50%. Installation must be performed in strict accordance with the most current version of Ma Maison Floors' detailed light commercial installation guidelines. Ongoing care and maintenance must follow Ma Maison Floors' recommended procedures for light commercial use and utilize only approved cleaning products. Failure to comply with these requirements may void this limited warranty.
Prohibition of Adhesive Tape: The use of any type of adhesive tape on the finished surface is strictly prohibited. The use of any adhesive tape will immediately and completely void this limited warranty.
Moisture Barrier Requirements: In applications where a moisture barrier is necessary, only adhesives specifically approved by Ma Maison Floors or explicitly specified by the adhesive manufacturer may be used. The use of non-approved or improperly specified adhesives will immediately void the warranty regarding any water or moisture-related damage.
Damage Exclusions: This limited warranty explicitly does not cover any damage to the Flooring that results from causes other than inherent manufacturing defects. This includes, but is not limited to, damage arising from or related to: Improper Maintenance, Neglect, or Abuse; Physical damage; Damage from heavy commercial equipment, machinery, or rolling loads; Damage from footwear; Water and Moisture Damage; Abrasives; Insufficient Furniture Protection; Improper Humidity Levels; Excessive wear and tear; Damage resulting from exposure to chemicals, spills, or other substances.
Surface Wear Limitations: Claims related to surface wear of the finish will only be considered valid if the wear is readily visible and affects a continuous area of at least ten percent (10%) of the total installed floor surface within a single room. Gradual reduction in the gloss level of the finish, which is normal wear and tear under light commercial use, is specifically excluded from this warranty coverage.
Discontinued Products: Ma Maison Floors cannot guarantee the availability of original products for replacement. If a claim for a manufacturing defect is validated, and the specific Flooring product or color is still actively available, Ma Maison will use that product for repair or replacement. However, if the specific Flooring product or color has been discontinued and is no longer being produced, Ma Maison's obligation is then limited to providing a replacement product of equal or greater value and similar aesthetic appearance at our sole discretion.
Use of Non-Approved Products: The use of any floor cleaning, polishing, or maintenance products not specifically recommended or approved by Ma Maison Floors will void this limited warranty.
Post-Installation Acceptance: Once the Flooring has been installed, it is considered accepted by the Purchaser. It is the sole responsibility of the Purchaser, or their designated representative, to thoroughly inspect all Flooring materials prior to installation to ensure they are free from visible defects. No claims for visible defects will be accepted under this warranty for Flooring that has already been installed.
Claim Documentation: All warranty claims must be submitted to the authorized dealer of original purchase, accompanied by original sales invoices, installation documentation, and detailed evidence (e.g., dated photographs) of the defect. Failure to provide complete documentation or file the claim within a reasonable period of discovery may result in claim rejection.
Service Limitations
Ma Maison’s warranty covers defects in flooring materials and workmanship only. It does not include ancillary services such as the relocation or storage of fixtures, furniture, equipment, inventory, or site preparation. The commercial customer is responsible for ensuring the work area is completely accessible, unobstructed, and ready for service. While Ma Maison crews may assist with moving a limited number of items at their discretion, this is a courtesy and not a warranty obligation. Ma Maison is not insured or equipped to perform large-scale moving services and assumes no liability for business property or inventory handling.
Remedies and Limitations Under this Limited Commercial Warranty
In the event that a defect covered by this limited warranty is confirmed by Ma Maison Floors, our sole and exclusive remedy will be, at our option, to either: (i) repair the defective planks; (ii) replace the defective planks; or (iii) provide a prorated refund to the Purchaser. The prorated amount will be calculated based on the number of years that have passed since the date of original installation and the expected lifespan of the product.
Access and Cooperation: The Purchaser must provide Ma Maison Floors or its designated agent with prompt and reasonable access to the premises to inspect the claimed defect. If a claim is validated, the Purchaser must also provide unimpeded access to allow for necessary repair or replacement. Ma Maison's liability for ongoing damage ceases if the approved remedy is declined or if reasonable access to perform the repair is not provided.
This limited warranty constitutes the complete and exclusive agreement between Ma Maison Floors and the Purchaser. In no event shall Ma Maison Floors be liable for any incidental, consequential, indirect, special, or punitive damages (including, but not limited to, loss of profits, business interruption, costs of removal or reinstallation, or damage to surrounding property) arising out of or in any way connected with the Flooring or its defects. The total liability of Ma Maison Floors under this limited warranty shall not exceed the original purchase price of the defective Flooring.
Installation Guidelines for Warranty Coverage
Proper installation is absolutely critical for ensuring the long-term performance and longevity of your Ma Maison Floors and is a fundamental requirement for this limited warranty to be valid. The following key guidelines must be strictly adhered to:
Timing of Installation: Wood flooring installation should be one of the final phases of any construction or remodeling project.
Job Site Evaluation: A thorough evaluation of the job site must be conducted to identify any potential issues that could adversely affect the Flooring.
Environmental Control: It is essential to ensure that the building's permanent heating and cooling systems are fully operational and maintaining consistent temperature and relative humidity (30% to 50%) levels for a minimum of five (5) days prior to installation, during the entire installation process, and continuously thereafter. These conditions should be maintained in accordance with the guidelines established by the National Wood Flooring Association (NWFA).
Moisture Testing: Thorough moisture testing must be performed on all subfloors.
Subfloor Preparation: The subfloor must be structurally sound, clean, dry, flat, and free of any contaminants. Any unevenness or imperfections in the subfloor must be corrected to meet the flatness tolerance specified in the NWFA guidelines, typically $\mathbf{3/16^{\prime\prime}}$ within a $\mathbf{10^{\prime}}$ radius or $\mathbf{1/8^{\prime\prime}}$ within a $\mathbf{6^{\prime}}$ radius.
